These terms and conditions constitute an agreement between you and Row Pinto Knitwear Designs. By using this website and making purchases from Row Pinto Knitwear Designs you agree to these terms and conditions. Row Pinto Knitwear Designs may change these terms at any time, please review these terms and conditions regularly to make sure you are aware of any changes made. If you do not agree to all the following terms you should not use this site. These terms and conditions are governed by the laws of England and agree to submit to the exclusive jurisdiction of the courts of the United Kingdom.

ROW PINTO KNITWEAR DESIGNS PRODUCT DETAILS
Row Pinto products are subject to availability. If a product is out of stock at the time when we receive your order, we will inform you and you will be given the option to wait until the Row Pinto products are available from stock or cancel the order and receive a full refund within 28 days.
We have tried to display as accurately as we can, the true colours of Row Pinto products, however we can not guarantee that the colour of a Row Pinto product as delivered will replicate how it appeared to you on -screen, as this is dependent partly on your computers display screen and how you perceive colour.
All sizes and measurements, concerning Row Pinto products are a accurate as we can make them. Slight variations may occur as the majority of the collection is handmade.
We aim to continually update the Row Pinto site and have promotions that are not available from our other stockists.
RIGHTS OF ROW PINTO KNITWEAR DESIGNS
Row Pinto Knitwear Designs reserves the right to periodically update prices on the website, which cannot be guaranteed for any period of time. Row Pinto Knitwear Designs will make every effort to ensure prices are correct at the point at which the buyer places an order.
Row Pinto Knitwear Designs reserves the right to withdraw any Row Pinto products from the website at any time.
Row Pinto Knitwear Designs will not be liable to anyone for withdrawing any Row Pinto products from the website or for refusing to process an order.
ORDERS AND DELIVERIES
Most of my items are either knitted or handcrated by me and in some cases there may be a delay in sending, we will contact you if there is an excessive delay with the despatch of your order.
We aim to despatch most items, except our cushions and throws, within three days of order depending on availability. Cushions and throws will normally be despatched within ten days as these items are knitted to order.
Goods outside the UK will normally be delivered within 30 working days of acceptance of the order.
Row Pinto Knitwear Designs shall use its reasonable endeavours to meet any date agreed for delivery. In any event time of delivery shall not be of the essence and the Row Pinto Knitwear Designs shall not be liable for any losses, costs of damages, or expenses incurred by the buyer or any third party arising directly or indirectly out of any failure to meet any estimated delivery date.
Items will normally be sent using Post Office 'recorded' delivery with a flat rate of £4.95 that is added to your order when you purchase a product from Row Pinto. Delivery times will vary according to how quickly Royal Mail delivers.
We recommend placing your orders early at particularly busy times, (such as Christmas) to make allowances for delivery delays.
We reserve the right to decline to fulfil orders for any reason, including a Row Pinto product that has been mis-published such as its specification or price. Orders are regarded as offers that we are entitled to accept or decline. If there are any problems with your order we will contact you.
We will send you an e-mail to confirm when your order has been sent.
All deliveries require a signature so please supply us with an address at which a parcel can be signed for. If you miss delivery it will be taken to your nearest Royal Mail sorting office where you can arrange redelivery or collect it.
Risk of Row Pinto products shall pass to buyer upon delivery of the Row Pinto products, or where the buyer fails to take delivery at the agreed time, at the time of delivery was attempted.
Title of the Row Pinto products shall not pass to the buyer until payment of the price has been made in full.
OUR RETURNS POLICY AND CANCELLING YOUR ORDER
We understand that you may sometimes want to return items that you are not happy with. You have the right to cancel an order for a Row Pinto product, beginning from 7 working days following the first working day after the day on which you receive it. A working day is any day except Saturday, Sunday and UK public holidays. You can cancel and order for a Row Pinto product by e-mailing: rowpinto@aol.com
If you cancel during this 'cooling off' period, you must return the Row Pinto product to us at your own cost within 14 days of the date you cancelled. You must take care of the Row Pinto product while you have it and items must be returned to us in perfect condition, with original packaging. If you cancel during the 'cooling off' period and return the Row Pinto product, in good condition, then you will receive a full refund of the price you paid for your Row Pinto product. If you fail to return the Row Pinto product in good condition to us within 14 days, then you will be responsible for payment of the price of the Row Pinto product. If you want a refund on a discounted Row Pinto product then you will be refunded the discounted price.
You remain fully responsible for Row Pinto products until they are received, returned items must be sent by recorded delivery as no reponsiblity can be taken for lost goods in transit. The address to return your items to is: studio 304, 18-22 Creekside, Cockpit Arts, London SE8 3DZ. Where returned Row Pinto products are found to be damaged due to the buyer's fault the buyer will be liable for the cost of remedying such damage.
The buyer shall inspect the Row Pinto products immediately on receipt and shall notify Row Pinto Knitwear Designs by e-mail to rowpinto@aol.com within 7 days if the Row Pinto products are damaged or do not comply with any of the Agreement. If the buyer fails to do so the buyer will be deemed to have accepted the Row Pinto products.
Where a claim of defect or damage is made, the Row Pinto products shall be returned by the buyer to Row Pinto Knitwear Designs within 28 days of delivery. In the unfortunate event that your Row Pinto product is in fact faulty, Row Pinto will pay for your return postage and a full refund including delivery charges.
If your item is to be exchanged it will be sent within 5 working days of receiving your return.
PRICE AND PAYMENT
The price of Row Pinto products shall be stipulated on the website. The price is not inclusive of VAT. The price is not inclusive of the flat rate delivery charge of £4.95 per order in the UK.
The total purchase price, including delivery charges, will be displayed in the buyers shopping cart prior to confirming the order.
After the order is received Row Pinto Knitwear Designs shall confirm by e-mail the details, description and price for the Row Pinto products together with information on the right to cancel if the buyer is a consumer.
Payment of the price plus delivery charges must be made in full before the despatch of the Row Pinto products. Customers sending payment via cheques may encounter a large delay in their order being despatched as we will normally need to clear a cheque.
Payments are processed at the time of ordering, however we only process orders that have been screened and accepted by PayPal. For details of countries and cards accepted by PayPal, visit www.paypal.co.uk
All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the card issuer does not authorise payment, we can not process the order.
In the event that your order is flagged by a 'warning' or 'caution' from PayPal, we will contact you for further information required. Without this further information being given within 3 working days, we will cancel your order and you will be refunded by PayPal.
When giving address details please note that there is a difference between the delivery address and invoice address areas of the order form. Your billing address is where your credit/debit card is registered to.
Row Pinto products do not include VAT , you as the purchaser are responsible for any other taxes or duties (such as import duties) payable on Row Pinto products, not us.
INTELLECTUAL PROPERTY
You acknowledge that all copyright, trade marks and other intellectual property rights in and relating to Row Pinto products are owned by us. No one may copy from, distribute, show in public or create any derivative work from Row Pinto site or products.
PRIVACY POLICY
Our privacy policy form part of this Agreement and by giving your Agreement, you also give your permission that we may handle your personal data in that policy.
LIABILITY
We maintain that Row Pinto products will be made with care and skill and with the intention of meeting our specifications for them. However we cannot and do not guarantee that Row Pinto products will meet your requirements.
Except as may be implied by law where the buyer is dealing as a consumer, in the event of any breach of these Terms and Conditions by Row Pinto Knitwear Designs the remedies of the buyer shall be limited to damages which shall in no circumstances exceed the price of the Row Pinto products and Row Pinto Knitwear Designs shall under no circumstances be liable for any indirect, incidental or consequential loss or damage whatever.
Nothing in this Agreement shall exclude or limit the liability of Row Pinto Knitwear Design's for death or personal injury resulting from our negligence or that of Row Pinto Knitwear Designs agents or employees.
WAIVER
No waiver by Row Pinto Knitwear Designs (whether express or implied) in enforcing any of its rights under this contract shall prejudice its rights to do so in the future.
FORCE MAJEURE
Row Pinto Knitwear Designs shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from the events or circumstances outside of its reasonable control, including but not limited to, acts of God, strikes, lock outs, accidents, war, fire, failure of any communications, telecommunications or computer system, breakdown of plant machinery or shortage or unavailability of raw materials from a natural source of supply, and Row Pinto Knitwear Designs shall be entitled to a reasonable extension of its obligations.
SEVERANCE
If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid illegal or unenforceable provision eliminated.
CHANGES TO TERMS AND CONDITIONS
Row Pinto Knitwear Designs shall be entitled to alter these Terms and Conditions at any time but this right shall not affect the existing Terms and Conditions accepted by the buyer upon making the purchase.
